Privacy Policy

This is an English translation provided for convenience. The Japanese version is the official text, and in the event of any discrepancy the Japanese version prevails.

Eye Factory Co., Ltd. (the "Company") establishes this Privacy Policy (this "Policy") as set out below concerning the handling of the personal information of affiliates ("Affiliates") who use "EYE FACTORY AFFILIATE" (the "Service"), which the Company operates and manages. The Company promotes the protection of personal information by building a framework for protecting personal information and by making all employees aware of the importance of protecting personal information and ensuring that they carry out these efforts thoroughly.

Article 1 (Personal Information)

  1. "Personal information" means "personal information" as defined in the Act on the Protection of Personal Information (the "APPI"): information about a living individual that can identify a specific individual by the name, date of birth or other descriptions contained in the information, or that contains an individual identification code.

  2. "Personal data" means personal information constituting a personal information database or the like.

Article 2 (Affiliate Information We Collect)

The Affiliate information (including personal information) the Company collects from Affiliates is as follows.

  1. Email address
  2. Username
  3. Password
  4. Account details for one of a bank account, PayPal or Wise
  5. Click history, access logs and results data
  6. IP address and device information

Article 3 (Purposes of Use of Personal Information)

The Company collects Affiliates' personal information to the extent necessary for the following purposes and uses the collected information. When using personal information beyond the scope of the following purposes, the Company obtains the Affiliate's consent in advance by appropriate means.

  1. To confirm results generated through the Company's services and to make payments and the like
  2. To improve and refine the content of the Company's services or to develop new services
  3. To provide information about new products, updates, campaigns, events and other services the Company provides (including sending emails, flyers and other direct mail)
  4. To contact Affiliates as necessary, such as for maintenance and important notices
  5. To respond to opinions, inquiries and the like from Affiliates about the Company's services (including verifying identity)
  6. To report to Affiliates on the status of their use of the Company's services
  7. To request cooperation with surveys and the like concerning the Company's services, to invite participation in various events, and to report their results and the like
  8. To investigate and analyze usage history of the Company's services and use the results for improving and developing the Company's services and for delivering advertising
  9. To provide personal information to companies participating in events hosted by the Company, based on the Affiliate's consent or application
  10. To identify Affiliates who have violated the Terms of Use or who attempt to use the Company's services for wrongful or improper purposes, and to refuse their use

Article 4 (Management and Protection of Personal Data)

Personal data is managed strictly, and the Company does not disclose or provide personal data to third parties without the Affiliate's consent, except in the following cases. In consideration of security, the Company takes preventive and corrective measures against risks such as unauthorized access to personal data and the loss, destruction, falsification and leakage of personal data.

  1. When necessary to protect a person's life, body or property and it is difficult to obtain the Affiliate's consent
  2. When particularly necessary to improve public health or promote the sound development of children and it is difficult to obtain the Affiliate's consent
  3. When it is necessary to cooperate with a national government organ, a local government, or a person entrusted by either in performing affairs prescribed by laws and regulations, and obtaining the Affiliate's consent would risk interfering with the performance of those affairs
  4. Other cases permitted by laws and regulations

Article 5 (Entrustment of the Handling of Personal Data)

The Company may entrust all or part of the handling of personal data to the extent necessary to achieve the purposes of use. In such cases, the Company thoroughly examines the suitability of the contractor, sets out confidentiality obligations and other matters in the contract, and exercises necessary and appropriate supervision over the contractor.

Article 6 (Disclosure of Personal Data)

An Affiliate may request the Company to disclose the personal data the Company holds, following the procedure set out in Article 9. Upon receiving such a request from an Affiliate, the Company discloses the data to the Affiliate without delay. However, if disclosure would fall under any of the following, the Company may decline to disclose all or part of the data, and if it decides not to disclose, it notifies the Affiliate to that effect without delay.

  1. When disclosure risks harming the life, body, property or other rights or interests of the Affiliate or a third party
  2. When disclosure risks seriously interfering with the proper conduct of the Company's business
  3. When disclosure would otherwise violate laws and regulations

Article 7 (Correction of Retained Personal Data)

  1. If personal data held by the Company is incorrect, the Affiliate may request the Company to correct, add to or delete the personal data ("Correction, etc."), following the procedure set out in Article 9.

  2. Upon receiving a request under the preceding paragraph, the Company conducts the necessary investigation without delay, and if it determines as a result that the request is justified, it carries out the Correction, etc. of the personal data without delay.

  3. When the Company has decided whether or not to carry out the Correction, etc. under the preceding paragraph, it contacts the Affiliate without delay.

Article 8 (Suspension of Use of Personal Data)

  1. An Affiliate may request the Company to suspend the use of, erase, or suspend the provision to third parties of the personal data the Company holds ("Suspension of Use, etc."), following the procedure set out in Article 9.

  2. Upon receiving a request under the preceding paragraph, the Company conducts the necessary investigation without delay, and if it determines as a result that the request is justified, it carries out the Suspension of Use, etc. of the personal data. However, where the Suspension of Use, etc. of personal data would require a large expense, or where it would otherwise be difficult to carry out, and alternative measures necessary to protect the Affiliate's rights and interests can be taken, the Company takes those alternative measures.

  3. When the Company has decided whether or not to carry out the Suspension of Use, etc. under the preceding paragraph, it contacts the Affiliate without delay.

Article 9 (Procedure for Disclosure of Personal Data)

To make a request under Articles 6 through 8, please fill in the required information and send it, together with the identity verification documents set out in (1), to the address set out in (2). A fee of JPY 1,000 is charged for each request for disclosure of personal data.

③ A power of attorney showing that the person is the Affiliate's agent

Article 10 (Procedure for Amending the Privacy Policy)

The Company reviews the content of this Policy from time to time and strives to improve it. The content of this Policy may be amended, except for matters otherwise provided by laws and regulations or in this Policy. The amended Privacy Policy takes effect when the Company notifies Affiliates by the method the Company prescribes or posts it on the Company's website.

Article 11 (Compliance with Laws and Standards)

The Company complies with Japanese laws and regulations and other standards applicable to the personal information it holds.

Article 12 (Handling of Complaints and Consultations)

The Company accepts complaints and consultations from Affiliates about the handling of personal information and responds appropriately and promptly. The Company also responds promptly and appropriately to requests from Affiliates such as for the disclosure, correction, addition or deletion of the personal information, or for refusal of its use or provision.

Article 13 (Security Control Measures)

For personal data entrusted to the Company by Affiliates, the Company prevents unauthorized intrusion into personal data and the loss, destruction, falsification and leakage of personal data by taking organizational, physical, human and technical measures such as restricting access to personal data files, recording access logs, and implementing security measures to prevent unauthorized access from outside. In the unlikely event of an incident such as a leakage of an Affiliate's personal data, the Company promptly reports to the supervisory authority in accordance with the APPI and related guidelines, and, following the instructions of that authority, takes the necessary measures such as measures to prevent similar incidents and measures to prevent recurrence.
